Terms & Conditions

Please have this reviewed by a lawyer before you rely on it. It is a working draft written to match how the shop actually operates. It is not legal advice, and it has not been checked by anyone qualified.

These terms are the agreement between you and Calyn Cadeau when you use this site or buy from it. Please read them before you order — placing an order means you accept them.

Three other pages form part of these terms and are worth reading with it: the return policy, the shipping page and the privacy policy.

Who can order

You must be 18 or older, or have the permission of a parent or guardian.

The name, address, phone number and email you give us must be your own and must be correct. Almost everything that goes wrong with an order goes wrong because of an address.

Your account

You do not need an account — you can order as a guest. If you make one:

• Keep your password to yourself. Anything done through your account is treated as done by you.
• Tell us if you think someone else has got into it.
• We may suspend or close an account being used for fraud, or to abuse the shop in the ways listed further down.

Ask us any time and we will close your account.

Placing an order

An order is an offer to buy, not a completed sale. The contract is formed when we confirm your payment has been received.

We may decline or cancel an order — before or after payment — if:

• the piece has sold out or turns out to be faulty;
• the price or description was shown wrongly;
• we cannot verify the delivery address;
• we have reasonable grounds to suspect fraud, or a payment method being used without permission;
• the order looks like buying for resale (see below).

If we cancel an order you have already paid for, we refund it in full. That is the whole of what we owe you in that situation.

Prices

Prices are in Malaysian Ringgit (RM) and are the final price of the piece — there is no separate tax added at checkout. Shipping is worked out from your delivery address and shown before you pay.

We may change prices at any time. A change never applies to an order already placed.

If a piece is listed at an obviously wrong price — a decimal point in the wrong place — we are not obliged to sell it at that price. We will tell you before doing anything, and refund you in full if you have already paid.

Payment

Payment is taken through Billplz, on Billplz's own payment page. Your card number and your online banking password are entered there, never here, and are never seen or stored by us. What you can pay with depends on where the order is going — see payment methods.

You are charged in Ringgit wherever you are. If your card or bank is not a Malaysian one, your bank converts at its own rate and may add a foreign transaction fee. That is between you and your bank. We add no surcharge of our own.

Your order is not confirmed until we receive confirmation of payment.

Holding your items

Once you begin checkout we hold the pieces in your bag for 20 minutes. If payment is not completed in that time they go back on sale and someone else may buy them.

We work in small runs and things sell out. If something you ordered becomes unavailable before we dispatch it, we will contact you and refund that piece in full.

Delivery

We ship to Malaysia and Singapore. Delivery times are the courier's estimates, not guarantees — once a parcel is with them, it moves at their pace.

Risk passes to you on delivery. Until then a lost or damaged parcel is our problem to sort out, not yours.

If a parcel comes back to us because the address was wrong or incomplete, we will contact you and can send it again once you cover the postage.

Orders to Singapore

An order to Singapore is an import. Singapore may charge GST and duty, and the courier may add a fee for collecting it. Those are charged to you by the courier, are not included in what you pay us, and are not ours to refund. The shipping page explains it in full.

Pieces made to your measurements

A Calyn Customade piece is cut for one person from the measurements you give us, so two things follow:

• The measurements are yours to get right. Take them carefully, or ask us first. We cut to the numbers you send.
• It cannot be returned or exchanged, because it cannot be sold to anyone else.

If the finished piece does not match the measurements you gave us, that is our mistake — we remake it or refund you in full.

Returns

The return policy forms part of these terms.

In short: contact us within 7 days of delivery, post it back within 7 days of our confirmation, unworn and with tags. Underwear and made-to-measure pieces cannot be returned.

What we say about the clothes

We photograph and describe every piece as honestly as we can.

• Colour. Screens differ. We do not adjust the colour of a garment in a photograph, but we cannot promise your screen shows it as it is.
• Measurements. The flat measurements on a product page are a guide. Small-batch cutting and sewing varies, and a piece within 2cm of them is made as intended.
• Images edited with AI carry a mark, and what that mark means is set out on the use of AI page.

What you may not do here

Please do not:

• use the site for anything unlawful, or to break someone else's rights;
• copy, scrape or re-publish our photographs, text or illustrations;
• buy in bulk to resell, unless we have agreed it with you in writing — talk to us instead, we are happy to;
• try to break, overload or get into parts of the site that are not yours;
• upload anything designed to do harm.

We may refuse or cancel orders, and close accounts, over any of this.

Our photographs, words and branding

The photographs, written copy, illustrations and the Calyn Cadeau name and logo belong to us. You are welcome to share them as they are — a post, a story, a link. Please do not use them commercially, alter them, or present them as your own without asking.

Anything you send us

If you send us a photograph or a message — with a return, a question, or a tag on social media — you keep it. You are giving us permission to use it to deal with your order, and nothing more. We will always ask first before using anything of yours in our own posts or on this site.

Other people's services

Some parts of an order are handled by other companies: Billplz takes the payment, couriers carry the parcel, and some pages link out elsewhere. We choose who we work with carefully, but we do not control them and are not responsible for their own terms or content.

Your information

What we collect and what we do with it is in the privacy policy.

If something goes wrong

We are responsible for supplying pieces that match their description and are of satisfactory quality, and for putting it right when they are not.

We are not responsible for indirect or consequential losses — for example a missed event because a courier was late.

Where we are liable, our responsibility is limited to the value of your order.

Nothing in these terms takes away rights the law gives you as a consumer, in Malaysia or in Singapore. Where the law gives you more than this page does, the law wins.

Changes to these terms

We may update this page. The version that applies to your order is the one published when you placed it — a later change is never applied backwards.

Significant changes will be noted by the date at the top.

General

If any part of these terms turns out to be unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to.

These terms, together with the pages they refer to, are the whole agreement between us about your order.

Governing law

These terms are governed by the laws of Malaysia, and the Malaysian courts have jurisdiction. If you are buying from Singapore, this does not remove the consumer protections Singapore law gives you.
